Welcome to MEW MEW. The terms "we", "us" and "our" refer to Dig Deep Brands LLC, a Wyoming limited liability company trading as MEW MEW. We operate this store and website, including all related information, content, features, tools, products and services (the "Services"). MEW MEW is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with the policies referenced in them, describe your rights and responsibilities when you use the Services. Please read them carefully: they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and by our Privacy Policy. If you do not agree, you should not use or access our Services.

SECTION 1 — ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your state of residence, and that you consent to any minor dependents using the Services on devices you own or manage.

To use the Services you may be asked to provide information such as your email address and billing, payment and shipping details. You represent that all information you provide is correct, current and complete, and that you have the right to provide it.

You are responsible for the security of your account credentials and for all activity on your account. You may not transfer, sell, assign or license your account to anyone else.

SECTION 2 — OUR PRODUCTS

We make every effort to represent our products accurately. Colors and appearance may differ from how they appear on your screen depending on your device and its settings. We do not warrant that the appearance or quality of any product will be identical to how it is depicted online.

Product descriptions may change at any time without notice. We may discontinue any product and may limit the quantities we offer to any person or geographic region.

Our products are household grooming and pet-exercise equipment for domestic cats. They are not veterinary devices and are not intended to diagnose, treat or prevent any condition. Follow the instructions supplied with each product. If your cat has a skin condition, an injury, or a medical condition of any kind, speak to a veterinarian before using a grooming tool on them.

SECTION 3 — ORDERS

When you place an order you are making an offer to purchase. We reserve the right to accept or decline any order. Your order is not accepted until we confirm acceptance, and we must receive and process your payment before an order is accepted. Please review your order carefully before submitting it, as we may be unable to accommodate cancellation requests once an order has been accepted. If we do not accept, change or cancel an order, we will attempt to contact you using the email address, billing address or phone number you provided.

Your purchases are subject to return or exchange solely in accordance with our Refund Policy.

You represent that your purchases are for your own personal or household use and not for commercial resale or export.

SECTION 4 — PRICES AND BILLING

Prices, discounts and promotions may change without notice. The price charged is the price in effect when the order is placed, as set out in your order confirmation email. Posted prices do not include sales tax, which is calculated at checkout where applicable.

Shipping within the United States is free on every order. We do not ship outside the United States. See our Shipping Policy for details.

We may run promotions governed by their own terms. Where those terms conflict with these Terms, the promotion terms govern.

You agree to provide current, complete and accurate purchase and payment information, and to keep it up to date so we can complete your transactions and contact you as needed. You represent that any payment card information you provide is true and complete, that you are authorized to use that card, and that you will pay the charges you incur at the posted prices, including all applicable taxes.

SECTION 5 — SHIPPING AND DELIVERY

All delivery times are estimates and are not guaranteed. We are not responsible for delays caused by shipping carriers or events outside our control. Once we transfer products to the carrier, title and risk of loss pass to you, except where our Shipping Policy provides otherwise for lost or stolen packages.

SECTION 6 — PRODUCT SAFETY AND ELECTRICAL PRODUCTS

Some of our products are mains-powered electrical appliances rated for 120 V, 60 Hz supply in the United States. They are for indoor, dry, household use only. Do not immerse the motor unit, do not use the product outdoors, and unplug the unit before cleaning it. Keep the product away from children.

Use of a mains-powered product with a voltage converter, outside the United States, or in any manner inconsistent with the supplied instructions, is at your own risk and voids any remedy we would otherwise offer.

SECTION 7 — INTELLECTUAL PROPERTY

The Services, including all trademarks, brands, text, displays, images, graphics, reviews, video and audio, and the design, selection and arrangement of them, are owned by Dig Deep Brands LLC, its affiliates or its licensors, and are protected by United States and foreign intellectual property laws.

These Terms permit you to use the Services for personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store or transmit any material from the Services without our prior written consent. All rights not expressly granted are reserved.

MEW MEW, the MEW MEW wordmark, the Mochi character and our product names, designs and slogans are trademarks of Dig Deep Brands LLC. Shopify's name, logo and product names are trademarks of Shopify. All other marks belong to their respective owners.

SECTION 8 — THIRD-PARTY LINKS AND TOOLS

The Services may contain links to, or embedded functionality from, websites operated by third parties. We are not responsible for examining or evaluating their content or accuracy, and we are not liable for any harm arising from your access to them or your dealings with them. Any third-party tools made available through the Services are provided "as is" and "as available", without warranty or endorsement, and your use of them is at your own risk. Review the relevant third party's terms and policies before you engage with them.

SECTION 9 — RELATIONSHIP WITH SHOPIFY

MEW MEW is powered by Shopify, which enables us to provide the Services to you. Any sales and purchases you make in our store are made directly with Dig Deep Brands LLC. By using the Services you acknowledge that Shopify is not responsible for any aspect of any sale between you and us, including any injury, damage or loss resulting from purchased products and services. You expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with us.

SECTION 10 — PRIVACY

All personal information we collect through the Services is subject to our Privacy Policy, and certain personal information may be subject to Shopify's own privacy policy at shopify.com/legal/privacy/app-users. By using the Services you acknowledge that you have read both.

Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit may be transmitted to and shared with Shopify and with third parties that may be located in countries other than where you reside.

SECTION 11 — REVIEWS AND FEEDBACK

If you submit any ideas, suggestions, feedback, reviews or other content ("Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute and display it in any medium for any purpose, including commercial use.

You represent that you own or have all necessary rights to your Feedback, that you have disclosed any compensation or incentive you received in connection with it, and that it does not violate the rights of any third party or contain unlawful, abusive or obscene material. You may not use a false email address or misrepresent who you are.

We do not offer payment, discounts, free products or any other incentive in exchange for a positive review, and we do not edit, filter or suppress reviews on the basis of how favorable they are. We may remove Feedback that is unlawful, abusive, off-topic or fraudulent.

We are under no obligation to keep Feedback confidential, to pay for it, or to respond to it.

SECTION 12 — ERRORS, INACCURACIES AND OMISSIONS

Information on the Services may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times or availability. We reserve the right to correct any error and to change or update information, or cancel orders, at any time without prior notice, including after you have submitted your order. Where we cancel an order for this reason, we refund you in full.

You may use the Services for lawful purposes only. You may not use them: for any unlawful or malicious purpose; to violate any law or regulation; to infringe our intellectual property rights or those of others; to harass, abuse, defame or harm any person; to transmit false or misleading information; to send unsolicited advertising or spam; to impersonate any person or entity; or to restrict or inhibit anyone else's use of the Services.

You also agree not to: upload viruses or malicious code; reproduce, duplicate, copy, sell or exploit any portion of the Services; collect or track the personal information of others; phish or pretext the Services; use any robot, spider, scraper or automated means to access the Services; or interfere with or circumvent the security features we use to protect them.

We may suspend, disable or terminate your access at any time, without notice, if we determine that you have violated any part of these Terms.

This section applies if you use, allow or cause the deployment of an Agent to access or interact with the Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of a person or entity without direct supervision.

Agents must: identify themselves in every HTTP request by including "Agent/[agent name]" in the user agent string; not conceal that access is automated, including by mimicking human interaction patterns or completing or circumventing measures intended to distinguish human from automated use; respond truthfully to any prompt seeking to determine whether the interaction is automated; and not circumvent any measure intended to block, limit or control automated access.

SECTION 15 — TERMINATION

We may terminate this agreement or your access to the Services at any time without notice, and you will remain liable for all amounts due up to and including the date of termination. The following sections survive termination: Intellectual Property, Reviews and Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, and Privacy.

SECTION 16 — DISCLAIMER OF WARRANTIES

The information presented on the Services is made available for general information purposes. We do not warrant its accuracy, completeness or usefulness, and any reliance you place on it is at your own risk.

EXCEPT AS EXPRESSLY STATED BY US, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THEM ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT REPRESENTATION, WARRANTY OR CONDITION OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE MAY NOT APPLY TO YOU.

Nothing in these Terms excludes or limits any warranty or right that cannot be excluded or limited under applicable law, including under the Magnuson-Moss Warranty Act.

SECTION 17 — LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO CASE SHALL DIG DEEP BRANDS LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA OR REPLACEMENT COSTS, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT PURCHASED THROUGH THEM, EVEN IF ADVISED OF THE POSSIBILITY.

WHERE LIABILITY CANNOT BE EXCLUDED, OUR TOTAL LIABILITY TO YOU IS LIMITED TO THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

SECTION 18 — INDEMNIFICATION

You agree to indemnify, defend and hold harmless Dig Deep Brands LLC, Shopify, and our affiliates, officers, members, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, payable to any third party arising out of your breach of these Terms, your violation of any law or the rights of a third party, or your access to and use of the Services.

SECTION 19 — SEVERABILITY

If any provision of these Terms is held unlawful, void or unenforceable, that provision shall be enforced to the fullest extent permitted by law and the unenforceable portion severed, without affecting the validity of the remaining provisions.

SECTION 20 — WAIVER AND ENTIRE AGREEMENT

Our failure to exercise or enforce any right or provision of these Terms does not waive that right or provision. These Terms, together with the policies posted on this site, constitute the entire agreement between you and us and supersede any prior agreements or communications. Any ambiguity shall not be construed against the drafting party.

SECTION 21 — ASSIGNMENT

You may not delegate, transfer or assign these Terms or any of your rights or obligations under them without our prior written consent, and any attempt to do so is void. We may transfer, assign or delegate these Terms and our rights and obligations without consent or notice to you.

SECTION 22 — GOVERNING LAW AND VENUE

These Terms and any separate agreements under which we provide Services are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law rules. You and Dig Deep Brands LLC consent to the exclusive jurisdiction and venue of the state and federal courts located in Sheridan County, Wyoming, for any dispute arising out of or relating to these Terms or the Services.

Headings are for convenience only and do not limit or affect these Terms.

SECTION 24 — CHANGES TO THESE TERMS

You can review the most current version of these Terms at any time on this page. We may update, change or replace any part of them by posting the revision to this website. It is your responsibility to check for changes. We will notify you of material changes in accordance with applicable law, and such changes take effect on the date specified in the notice. Your continued use of the Services after a change constitutes acceptance of it.
